Wowwowowow! Thanks for all the amazing feedback. So many choices, but they don’t seem like they’ll break the bank so maybe I can afford to get him a couple different ones to try out and go from there. Thanks for taking the time and energy to recount your experiences. It’s much appreciated!

In Ward 6 we’re somewhat lucky in that respect. Don’t know the OP’s location though.

    I’m in Ward 1/Jim Graham.

    Hi,

I’m the OP. Thank you so much for your support in this matter. I’m taking stock of all the good info and suggestions and will keep you apprised. I have found a lawyer who’ll represent me in a civil suit, but I’m really more interested in the criminal charges and no one yet is interested in pursuing. It’s the police I’m upset with and I do intend to go up the chain of command starting with writing my councilmember.

To the person who experienced a concussion….how long did it take before you were back to normal? And are you really back to normal? I cannot tell you how much more sympathetic this little incident has made me and how lucky I feel . Can’t imagine if this was something permanent….also shudder when I think of what might have happened if I wasn’t wearing my helmet!

Glad your sense of humor wasn’t damaged.

    How’s it going now?

Thanks for the concern. Well, not the best. I had to go back into the hospital…a hospital of my choosing rather than the ambulance’s. My Dr. said it sounded like I had a concussion and had to go in for follow up tests to make sure there was no bleeding in my brain!

What were the symptoms? I’ve been experiencing dizziness, forgetfulness, headaches, inertia, emotional withdrawal, poor reflexes and a host of other symptoms consistent with the mild traumatic brain injury I’m told I have. It feels like I am high all the time. It sucks. I’m told by the Dr’s I won’t be able to resume normal activities at full function for 5 weeks average…maybe more, maybe less. That means no cycling, running, driving for long periods, no heavy physical activity (I was in the midst of training for the Nat’l Marathon, but that’s over), etc. Basically my brain is bruised and I have to take it easy until it heals. I also have noticed pain in my legs when I walk, dull pain in my arms (pulled muscles? I don’t know yet) Pain in my neck (no broken bones, thankfully) and who knows what else as time goes by.

I can’t believe this isnl’ even going on this woman’s driving record!

Sorry to hear that, and I hope you feel better and get justice too.

Is it too early to note the irony of your misspelled thread headline?

Actually, It’s too late :-) I saw it the second I hit the “post” button and noticed the irony at once. Therein lies the ugliness and beauty of electronic transmission.

    Hi,

I need to speak up here. I’m the poster who got hit on Monday on Irving Street. I just got my accident report and was referred to as a pedestrian. Here you are cited as a vehicle. I just don;t get how they quantify whether you are a vehicle or a pedestrian. There’s no consistency which is also a testimonial to the fact that we need more laws set into place where cyclists are concerned! Who sets the standards or is it up tp the whim of the offiocials involved and what is most convenient. This is a real problem.

    Thanks Liz,

You are so right and I appreciate your concern. It’s hard for someone not familiar with the legalese to know how to describe the scene accurately enough to get good advice and not make mistakes in the telling of the story. I really have nothing to hide here, but I hear you. I’ve alreadu spoken with a lawyer and he has the accident report.

That sounds awful. I hope you are healing and take time to rest and recover properly. WABA has some good info on what to do in a crash, and even though it is after the fact, I’m sure they could offer some advice. There is a phone number to contact them on this link:

Thanks to everyone for all your support. Yes. I left a message with Shane yesterday. Hoping to hear back from him.

Was the driver arrested? That doesn’t sound like an “I didn’t see the cyclist” case. That sounds like deliberate assault, battery, possible worse. Deliberately crashing into another vehicle is a serious crime.

No arrests. Not even a ticket. I asked the officer if he wrote up a ticket when I spoke to him on the phone. That’s when he replied, well it’s her word against yours. What does that matter?, I thought. She hit ME. I was visible to her while she was driving for at least half a minute!

I’m glad to hear that you are okay. From what you have described this definitely sounds like a case of aggressive/reckless driving. My first piece of advice would be to find a competent lawyer to bounce a few things off of. In the meantime you need to:

    1. Have your statement taken in person at the precinct headquarters – no exceptions.
    2. Secure a printed copy of your statement.
    3. Ensure that you have access to or copies of all pertinent medical findings.
    4. Collect relevant contact information either from the case officer or others.

From there any legal professional should be able to start pressing the right buttons to get this investigated and pursue any personal injury claims.

    Feel better.

Thanks. I will definitely go to the precinct to have them take my statement in person. My worry is that if they already filed the report, can it be ammended? You bet I want to have his investigated but in respect to bouncing this off a lawyer, I’ve been told by an attorney friend that they are skeptical any attorney would want to take the case because there were no broken bones.
